Or which cop, or which judge. Technically, there is no prohibition on mobile monitoring of police communications in NY. The V&T prohibits equipping a motor vehicle with a receiver that can tune in police frequencies. Nothing about using it in the statute. A cellphone cannot tune police frequencies. If you get cited, then you should probably hire a lawyer and/or expert witness who can explain the difference to the judge.
